Abstract

Violence in marital relationships is one of the significant challenges in contemporary societies, which can lead to the destabilization of the family foundation and cause serious psychological and physical harm. Violence in this context encompasses physical, emotional, and financial dimensions, including behaviors such as assault, humiliation, threats, deprivation of property and legitimate rights.
In Imamiyah jurisprudence where marital relationships are based on affection and good treatment, the use of violence within family relations is condemned, and any violent behavior causing harm to spouses is considered contrary to the principle of living together with kindness and is regarded as prohibited.
In fact, any violent behavior in all dimensions, whether by the husband against the wife or viceversa, is regarded as a breach of the obligations arising from the marriage contract and entails specific jurisprudential and legal consequences. Among these, financial violence is one of the less addressed issues. Accordingly, this study, using a descriptive-analytical method and relying on library resources, aims to explain the nature of violence According to Islam, some examples of financial violence in marital relationships, and the rulings on these cases based on jurisprudence.
One of the important aspects of this investigation is understanding status of rights and duties of spouses towards each other. The findings of this study indicate that from the perspective of Imamiyah jurisprudence, the interference or encroachment of spouses on each other’s financial matters, or depriving each other of financial rights that conflict with the rights of other party, is considered violence and unlawful.
